Serving as their mediation attorney, I prompted them with different scenarios and questions so they are aware of the issues that may arise later. Now that they are knowledgeable and informed, I am drafting a thoughtful agreement for co-ownership that will stand the test of time for years to come.
I am going to be able to help this couple and their kiddos navigate the separation and divorce amicably without going to court. And we’ve created a settlement that focuses on the best interest of their children. And by doing so, the couple enters their next chapters committed and capable of being the very best co-parents to their children.
Active-Duty Military Divorce Mediation San Diego:
Highlights
I have extensive experience creatively tailoring child custody plans through mediation for active-duty service members. Military members often can’t control the location of their assignments, and this can create challenging divorce scenarios.
I am writing a settlement agreement today for clients. Serving as their mediator for divorce, we’ve agreed on a settlement that includes a provision for the non-active-duty parent to move to the same city as the active-duty parent in the future. This is a creative solution that really emphasizes the children’s best interests. There are many nuances to this sort of arrangement, but I have seen it be successful many times over the 20 years I’ve worked as a family lawyer.
We have also agreed upon the division of the military pension plan, CalSTRS pension plan, 401(k) and all their assets. And mom agrees to pay all of the school costs in exchange for not having to pay direct child support. Again, creative solutions that require an experienced attorney to get the court to approve the agreement.

The couple paused their litigation and decided to hire me to help them divorce without attorneys. My client has a trust fund and significant monthly funds received from inheritance and still living family members. He relies on the family funds and inheritance as he is passionate about living a fun, exciting, wave filled existence that doesn’t involve a whole lot of work time. His fiancé is the love of his from a foreign country on a 90-day visa. My client’s family fears what could happen if things don’t work out forever. Hired to represent my client as his Encinitas prenup agreement attorney, here’s a bit about how we landed with a win-win agreement.
Working with my client drafted a prenup that protects my client in the event of divorce but which simultaneously provides a smooth landing for his fiancé if they were to divorce. California Code 1615 states that a prenup is not enforceable during divore when the prenup is too one-sided or unfair. Often a judge voids the prenup because he or she find if the judge finds it to be unfair and inequitable. That’s not the exact language but it describes the power a judge has regarding prenups. If the judge thinks it’s too harsh, too unfair or just doesn’t like the prenup for any reason, he or she can shred it.
Given that my client has tremendous wealth, and his fiancé has few assets, the potential for fairness being a problem during a future divorce is very real.
The prenup has been agreed to and is being signed later this week. It fully protects his family supplied monthly funding, the trust fund, the real estate he owns and all future inheritance.
In the prenup we also have included thoughtful limitations on spousal support if they divorce. We arranged tiers and have agreed on the payments due if they divorce. Less years of marriage results in a smaller payment obligation.
With my experience and not too shabby negotiation skills, we’ve reached a deal and now they can go get married and hopefully never call me for mediation help!
